Your NY Knicks Trial Update:

First off, one small regret - I likely won't be able to make it to the courthouse tomorrow to watch some of the trial, like I had hoped.  It's a shame, as James Dolan is expected to testify tomorrow.  Maybe I'll make it out on Thursday.

Now some boring developments in trial, and one really amazing revelation from the local media at the end of this post - make sure you read that part if nothing else:

-I'm gonna skip the news yesterday about Isiah's bizarre comments on how it is worse when a white man calls a black woman a "bitch" than when a black man does.  It's obviously been well documented in the press, once again putting the trial back on the front page.  Well done, Knicks.  Seriously... I'm beginning to think that they really must believe the old adage "any press is good press", because they seem determined to knock OJ right off the front page.

It was a throwaway line that was not relative to the trial, and Isiah apparently spat it out unforced, with no real prodding from the questioning lawyer.  Very odd.

-Okay, I will offer up an opinion on what he said:  Basically I both agree and disagree.  On the one hand, I agree that it may be worse coming from a white male towards a black female - it's almost both a gender slur and doubles with slightly racial overtones.  I guess coming from a black man it's just a gender slur.  Of course, it should be noted that it is still a gender slur, and should not be used to describe a woman ever, period.  

On to today's stuff:

-Jeffrey Nix testified.  He's a former 15-year employee of the Knicks, recently let go (last month), and he testified to support Anucha's account.  He basically recounted a few conversations Anucha had with him in which she spoke of how harshly Isiah treated her:

In March 2004, according to Nix, Anucha told him that Isiah asked her "What the fuck is your job?  What are your job responsibilities, you fucking ho?"

It should be noted that he's not testifying that he heard Isiah say this, just that Anucha told him "this is what Isiah said".

His first-hand experience was limited to seeing Isiah hug (or embrace) Browne Sanders in MSG, and watching Anucha push him away.  

She later told him that Isiah had said to her "I'm in love with you", and that she was confused by Isiah's sudden switch in his treatment of her, from abusive to amorous.

Oh, according to Nix, Anucha told him that at another meeting with Isiah he told Anucha "Don't forget, you fucking bitch, I'm the president of this fucking team".  

At the end of the day, I'm not sure Nix adds much to the trial - he's just repeating what Anucha said to him.  I guess the plaintiff's lawyer figure hope this makes it seem like Anucha is telling the truth, because if she was complaining about Isiah back in 2004 to coworkers, then it seems less likely she came up with this sexual harassment suit to save her job in 2005.  

-Robert Levy testified today, too.  He's a lawyer and season-ticket holder.  He attended an open practice at MSG in October 2005, and testified that he heard Thomas introduce Browne Sanders to a third person (whom he believed to be Michael Ray Richardson, of "the ship be sinking" fame), and made her feel "uncomfortable".  He said Thomas said "she was doing a terrific job" and "it could be very distracting to work next to someone who was so easy on the eyes".  Oh, and that Isiah "couldn't get any or no love from her".

Levy said that Isiah's hand was "draped over Brown Sanders' shoulders", and that "she seemed to be pulling away and had an uncomfortable smile on her face, if you could call it a smile".

This is somewhat damaging stuff, in my opinion.  You have a third person, seemingly completely objective (as opposed to Nix, who is a former employee and friend of Anucha) coming in a testifying that he heard Isiah say "he couldn't get no love" and making her feel a bit uncomfortable.  On the other hand, perhaps the jury will look at it as not really being a smoking gun, either.  None of that stuff is an absolute indicator of sexual harassment, so the Garden may yet salvage a victory in this trial.

Finally, check out this article today from NY Post Knick beat writer Marc Berman.  He's been on vacation, but he's brings up some great points:

-First he points out that no matter what, James Dolan and the Knicks are losers in the case, because of the bad publicity.  This is similar to what has been my take all along.

-He's surprised that Dolan, someone who has been quite paranoid about media coverage for a long time, even allowed this trial to happened.  Again, I agree.  I'm still shocked by that, and can only guess that he's so pissed off by Anucha (either because she wouldn't settle, or because he really thinks she's full of sh*t) that he decided to take the bad press just to avoid caving-in to her.  That's some serious hate. 

-Then comes the good stuff.  Berman talked to Stephon Marbury about this possible trial last month, and they both "predicted the salacious details of the trial were headed for the front page". Again, if Marbury and Berman (and SML) could all see this coming, I think Dolan could, too.  So why didn't he take action to prevent the trial, again?

-He points out that he feels bad for the intern, because she is "good at her job", and "as nice as can be".  And that she still works for the team.

-Berman actually defends the Garden, despite being one of the most outspoken critics of the Garden, Isiah, and Dolan over the years.  He says:

"I wouldn't pin sexual harassment in its truest form on the Garden.  Anucha, according to multiply sources across the years, was a very tough person with who to work because of how driven she was.  It seemed her ambition was to become the first women's GM in the NBA and probably saw Isiah derailing that goal."

Then he tops it off with firsthand accounts of Anucha's unprofessionalism:

"there were things that I deemed as unprofessional... watching Anucha go onto the court after practice and shoot baskets while the players were still out there.... she once chewed out Clarence Weatherspoon in the weight room for being too heavy."

Admittedly not the worst of crimes, but we have to say - the Knicks should put Berman on the stand.  He's probably done more to help their case than anything they presented so far in the trial....

It should be noted that Sanders was like an All Big 10 Player at Northwestern. Having her shoot on the floor with the players is probably a good influence on them.

I'm not going to get into the black/white woman deal...a woman is a woman and should never be talked to in that manner (that's just my personal opinion). I don't think it helped Zeke that when he made a statement to the media outside the courthouse he used the 'b' word again.

It's obvious that Isiah can talk people into believing him and I think that's what happened here. He knew his job was on the line, for many reasons. Remember that when this first came out he was just given the 'one season to get the job done' talk. I'm guessing he told Dolan that this was all an effort by Sanders to get some cash, Dolan believed him and went 'all in' on Isiah's word. Again, this is all just what might have happened.

I think she's going to get some cash, but not the $10 million she's looking for. She's going to be out of the NBA, which isn't bad on the pocketbook, and the Knicks are going to be out some sponsors and endorsement cash.

This just makes the Knicks look really, really bad.

I'm also wondering about the internal investigation the Knicks had about this situation. It was my understanding that they found Sanders claims to be weak and recommended going to court. Have the findings of that investigation been similar to what has been going on in court?

Jack Cobra: I, too, am curious about their supposed "investigation" - one, they have yet to prove (from what I've read) that they really took the claims seriously. That's the most damaging aspect of the trial for the Knicks. They probably won't be found guilty of the sexual harassment - that's really difficult to prove, and thus far all Sanders' lawyers have produced is her testimony, and second hand accounts.

But the Knicks are in serious danger of losing the retaliation aspect of the trial - if they didn't take the complaints seriously, but instead fired Anucha for making complaints... that's really bad. Today's paper includes this testimony from Dolan himself: He fired Anucha himself because he felt she was "interfering" with their investigation into the allegations. "I felt the overall health of the Garden was at jeopardy here" is the Dolan quote.

In my opinion, Dolan has to show what it was that Anucha did that specifically interfered with their investigation, or jeopardize the health of the Garden. Otherwise it looks like he straight up fired her for complaining about sexual harassment, which is the definition of "retaliation".

Hey Ricky: I don't really care that much about the case, but there isn't much else going on. The basketball season is still a few months away, the baseball playoffs haven't started yet, football season is really a once-a-week kind of thing, the FIBA Euros were televised (you are very lucky to have gotten to have seen so many good games!), etc.

And, yes, this is kinda a big deal locally. It's getting front page coverage almost daily in the local papers, and gets quite a bit of airtime on the TV newscasts. Nationally it's been picked up by most sports media outlets to some degree - ESPN has it on their website, and various of the big blogs have written posts on it, sometimes multiply posts. So it is somewhat big. Of course, there is no reason for me to write daily about it, but again - I have little else to write about that's more interesting right now!

Yeah, I just read Dolan's testimony...not good. You have to go through certain procedures in a organizational setting in order to fire someone like that. I think his testimony hurt the Knicks as much as any testimony so far.

Great insight on this, as usual, SML. But really, all of you who say they should just pay her to go away--$10 million dollars?! I think that's more than many of the NBA superstars will make this year. And what's with Sanders shooting baskets on the court while the players are there? I don't like the sound of that at all. Front-office types can't be randomly inserting themselves into the team's business. That's not their place.

MCBias....it was after the practice. I always see people on the Berto Center Court (where the Bulls practice) while Scott Skiles is giving his post practice interview. It's a perk of the job. Plus...she was an excellent basketball player, so maybe she was just shooting around.

Nah, Cobra - it would be okay if the players weren't still out there. Sometimes players stay for a bit after practice, usually free throws and stuff. Or in Nate Robinson case, half-court shots (not the most urgent thing to practice, but whatever). My general belief is wait until the players are done, then it's open to whoever - other personel, including mascots. Um, I mentioned that because mascots do have to practice those crazy halfcourt shots, too.

Hmm... maybe the Knicks should hire Nate to double as their mascot?

If it's after normal 'practice' time...that means open gym. At least that's what it used to mean when i was at college....which is about the level the Knicks have played at the past few season (enter laughter)

Cobra, I have to write on message boards somewhere; since Yaysports has gone temporarily downhill (especially on Fridays :-p) I just found another one.

Although, really, JC, you make it sound like the Knicks court is your local YMCA or something. Perspective? This is the court of an NBA team! Why should anyone be shooting baskets on it besides the players themselves?

They don't practice on the actual MSG court they play games on dude. My guess is that it's completely off-site and possibly just a former warehouse/gym of some sort.

It's a basketball court, everyone/anyone should be allowed to shoot on it. That's what makes basketball great. Have ball, will shoot. I've shot around in everything from a tux to my boxers.

This is very insightful coverage, SML. And you do a good job presenting both sides and not siding one over the other.

I've never been a Knick fan, and I think Sanders' case has some merit behind it. But Sanders didn't help her case any by throwing that intern into the fire and destroying her reputation.

None one is going to come out looking good here. Following this is a little like following a train wreck... you know everyone concerned is going to be seriously marred, but you can't help watching...

I think that treatments of some timberland shoe company sort had caused a lot of her hair to fall out. We shared things about our lives. She never mentioned family, and I did not ask.
